Rule of law according to Cerar: prime minister of Slovenia has been breaking the law for three months by not answering a clear question

The office of the prime minister of Slovenia does not want to provide an adequate answer to questions about the second track, more precisely about its price and length, which they are obligated to provide within seven days according to media law. The questions from the editorial board of Nova24TV for the prime minister are simple, but we have only received ambiguous half-answers. The questions were also forwarded by the information commissioner, but nevertheless they have still not answered.

The sixth paragraph of article 45 of the Media Act stipulates that authorities must answer questions from the media no later than seven working days after receiving the questions in writing. In accordance with the first paragraph of the same article, the information must be truthful and comprehensive. Because the prime minister has not complied with this law, we have contacted the information commissioner of the Republic of Slovenia, who has forwarded the questions to the office of the prime minister with the added request: “Since it is evident from the applicant’s statements that you did not fully respond to their request within 7 working days, as required by Article 45 of ZMed, or did not refuse to answer the question within this period, I urge you, in accordance with the first paragraph of Article 255 of the General Administrative Procedure Act, to decide on the request of the applicant according to the provisions of ZMed and ZUP and inform us about it no later than three days after receiving this appeal.” 

The office of the prime minister of Slovenia answered the questions from Miro Petek, editor-in-chief, and Boris Tomašič, director of Nova24TV, very vaguely, and they also told them to direct all their questions to the Ministry of Infrastructure, even though they are the ones that are obliged to answer by law. After three appeals from the information commissioner and after some dozen e-mails that were exchanged between the editorial board of Nova24TV and the office of the prime minister of Slovenia, the latter still do not want to provide correct answers about the matter.
