Lawyer Radovan Cerjak exposed the lies of the mainstream media and the players of the left-wing political network. The influential players and media in the service of the former regime have accused Minister of the Interior Aleš Hojs of political pressure in the work of the police and the prosecutor’s office, as he requested the revision of some controversial criminal investigations. “I really do not understand the media reports on the request for the revision of certain cases, made by the Minister of the Interior. A minister is a person who bears political responsibility for the work of his Ministry and the bodies it is responsible for. The State Administration Act is perfectly clear. Read Articles 23 and 24 of the State Administration Act. What Minister Hojs demands is completely legal and logical,” wrote the lawyer Radovan Cerjak. In addition, Article 6 of the Organisation and Work of the Police Act clearly states that “supervision over the work of the police is ordered by the Minister.”
The media are continuing with their daily attacks on the Minister of the Interior, Aleš Hojs, who ordered a revision of some already closed cases, handled by the National Bureau of Investigation, and are even asking “experts” to comment on the matter, with the intention of publicly smearing the Minister, whose actions are completely legal and legitimate. Lawyer Radovan Cerjak pointed out that Article 23 of the State Administration Act states that the Minister gives mandatory instructions to the constituent body and instructs it to perform certain tasks or take certain measures within its competence, and report back on the results. And Article 24 states that the Ministry supervises the work of the constituent body. The Minister may request reports, data, and other documents, related to the performance of the work of the constituent body. At a special request by the Minister, the head of the body must also regularly report back to him on the work of the body and on all of the important issues in its areas of work.
In addition, the Organisation and Work of the Police Act, which is a lex specialis, clearly stipulates that “the Minister orders the supervision of the work of the police.” Namely, supervision determines the legality, professionalism, and respecting of human rights and the fundamental freedoms in the exercise of the police powers, the performance of the police tasks, and the implementation of the Minister’s guidelines. All this is prescribed by law, but the mainstream media are intentionally ignoring it, and are instead lynching the Minister.
In the past, revisions of the proceedings in the case of the Carinthian boys were carried out in a similar manner, during the time of the former Minister of Labour, Family, Social Affairs and Equal Opportunities, Anja Kopač Mrak. Minister of the Interior in Cerar’s government, Vesna Györkös Žnidar, also acted similarly, when she ordered the supervision of the work of the National Bureau of Investigation. The current Minister of Defence Matej Tonin did the same in the case of a staged attack on Danijel Malalan, by a Slovenian soldier. There have been many such cases, and we will write about them in the future.
Minister Hojs is only doing what many ministers before him have done in various matters, under the previous governments
Minister of the Interior Hojs ordered the Acting Director-General of the Police Andrej Jurič to carry out a revision of certain controversial investigations from the past. According to the Ministry, this applies to the investigations at the Bank of Slovenia from 2012, the case of alleged abuse of Pro Plus’ dominant position in television advertising, the criminal complaint against the NLB bankers in the Farrokh case which was rejected last year, the alleged corruption in healthcare in the case of purchasing the vascular stents, and the case of investigation of suspected abnormalities in the children’s cardiac programme.
Former director of the criminal police Dušan Mohorko, who is now a lawyer, was among the first to reveal the truth, amid the coordinated political and media attacks on Minister Hojs. In his message, he wrote that Minister Hojs is not doing anything illegal. He reminded everyone of the suspicious practices of the former Minister of the Interior in Drnovšek’s government, Rado Bohinc. “What Minister Bohinc’s colleagues wanted to control in the criminal police – that really was illegal… (the journalists knew about it – but did nothing…) I wrote about it in my book, too… Hojs is following the law, and yet, an entire odyssey is happening,” the former director of the criminal police wrote.
In his post, lawyer Radovan Cerjak stated a few more facts that those who are heavily involved in the aforementioned scandals, want to sweep under the rug at any cost. “If the detectives acted professionally in cases such as the laundering of Iranian money in the NLB (didn’t this exact bank pay almost a million euros to the man who is in charge of publishing these lies on POP TV?), the procurement of vascular stents (wasn’t Mladina being financed by the money intended for this?), and others, then why would they be afraid of a revision? However, if they did not act professionally, something like that needs to be “cut out” of the Ministry. For the benefit of all citizens.”
Our media outlet has exposed all of these scandals of the influential, left-wing political network to the Slovenian public, but unfortunately, 90 percent of the “independent” media outlets in the service of the former regime hid all of this from the public. But they know very well that under the current government, the truth will come out, so since the first day of the new government’s term, they have been waging a media and political war against it, the likes of which we have not experienced before.
The shadow of a doubt when it comes to the work of the police needs to be removed
At the request of Hojs, the revisions will check the adequacy of the regulation of the operating of the National Bureau of Investigation, on the basis of the applicable regulations, and examine whether these regulations may need to be amended. The Ministry also stated that the proceedings, which the prosecution concludes with the dismissal of charges, may be the result of “poor work of the police, and not only the innocence of the suspects.”
“Therefore, in all these extremely high-profile and very expensive cases for the taxpayers, every shadow of a doubt about the work of the police must be removed. However, it may also be established that the work was not done as it should have been, and new facts may be discovered, on the basis of which the prosecution will have a reason to continue its work. In both cases, this would only be a confirmation that the decision for the revision was correct,” they wrote.
